Terms of Service

These Terms govern your use of CallCompanion, operated by All Spark Enterprises Ltd.(“we”, “us”), Devlin, Ontario, Canada. By creating an account or using the service you agree to them. If you don’t agree, don’t use the service.

1. The service

CallCompanion is an automated (AI-assisted) call-screening and routing tool. It greets callers, transcribes and classifies what they say, routes urgent calls, queues others, and sends callback texts. It is a convenience tool, provided “as is”, and is not a guaranteed or monitored answering service.

2. Eligibility

You must be 18+ and use the service for a lawful business purpose.

3. Your responsibilities — call recording & consent

You are responsible for complying with all laws that apply to recording, transcribing, and handling your callers’ calls and personal information (including PIPEDA, Quebec Law 25, CASL, and any consent requirements in your and your callers’ jurisdictions). CallCompanion plays a notice at the start of each call telling callers the call may be recorded and handled by an automated assistant, but ensuring your use is lawful — and obtaining any additional consent you may need — is your obligation, not ours.

4. Acceptable use

Don’t use the service for unlawful, harassing, deceptive, or high-risk purposes; for emergency, medical, safety, or life-critical communications; or in any way that violates telemarketing or anti-spam laws. Don’t resell or reverse-engineer the service.

5. Fees, trial, cancellation & refunds

Plans are billed monthly in Canadian dollars. Each plan includes a set number of calls per month; calls beyond that are billed at the per-call overage rate shown at sign-up. New accounts get a 14-day trial for $5.00 (non-refundable).

Cancellation: you can cancel anytime from your billing page; cancellation stops future billing and takes effect at the end of the current paid period, which you keep access to. Refunds: fees already paid, including the one-time setup charge and the current period, are non-refundable except where required by law. Full details are in our Service Agreement.

6. Intellectual property & your data

We own the CallCompanion platform. You own your business data and your call records. You grant us the limited licence needed to process that data to provide the service (see our Privacy Policy).

7. No warranty; AI limitations

The service relies on automated speech recognition and AI classification, which are not always accurate. It may mis-transcribe, mis-classify, mis-route, or miss a call, and phone and internet networks can fail. We provide the service without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Do not rely on it for urgent, emergency, or safety-critical matters.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, missed or mishandled calls, or lost opportunities, arising from your use of (or inability to use) the service — even if we were advised such damages were possible. Our total aggregate liability for any claim is limited to the fees you paid us in the three (3) months before the event giving rise to the claim.

9. Indemnification

You will indemnify and hold harmless All Spark Enterprises Ltd. from any claim, loss, or expense (including reasonable legal fees) arising from your use of the service, your call content, or your failure to comply with these Terms or applicable law — including any claim brought by one of your callers.

10. Termination

You may cancel anytime. We may suspend or terminate accounts that violate these Terms or that create legal or security risk.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, and disputes are subject to the courts of Ontario.

12. Changes

We may update these Terms; material changes will be posted here with a new effective date. Continued use means you accept the updated Terms.
